Terms of use

Introduction

These Terms of Use set out all provisions that you agree to when using nodemapp.com, the NodeMapp Bike or NodeMapp Hike app (available from Google Play and the App Store) or any of their derivative products, hereinafter referred to as "apps".

Article 1

The apps are owned by NodeMapp BV, with KBO number 0834.906.219, located at Corbeillestraat 2, 2235 Hulshout (Belgium). By accessing and using the apps, you agree to these terms of use.

Article 2

The content of the apps, including brands, logos, drawings, product or company names, texts, images, etc. are protected by intellectual rights and belong to NodeMapp BV or entitled third parties. You require permission from NodeMapp BV to reuse or copy information from the apps.

Article 3

To access certain features within the apps, it is necessary to create a NodeMapp account. To create an account, enter the requested personal data into the registration form within the apps. It is not allowed to share this data.

Article 4

The user understands that Nodemapp BV in its apps provides (road) maps via digital way (with additional functionalities) which are public and can be consulted by anyone. NodeMapp BV does not bear any responsibility for the accuracy of the routes published in the apps, the state of the published cycling/hiking routes, the signage on the terrain, etc. This of course applies all the more if the user deviates from the routes and creates his own routes on the map. In any case, like any other road user, the user remains solely responsible for assessing local situations, local conditions, signalling, the private or public nature of a road, etc. To the extent that user errors lead to claims for compensation in respect of Nodemapp BV, the user shall fully indemnify Nodemapp BV.

Article 5

NodeMapp BV cannot be held responsible for accidents or irregularities, committed by the users of the apps while following a publication (route) in the apps. NodeMapp BV urges the users of the routes to scrupulously adhere to the published routes and not to cause any damage, neither to the public domain, nor to the property of third parties.

Article 6

NodeMapp BV makes great efforts to display all information in the apps as accurately as possible. However, it cannot be ruled out that in certain situations, local conditions in the field may deviate from the information displayed in the apps. We are referring here in particular to the routes to be followed that are visible in the apps. When a route in the apps deviates or takes a different route than indicated by the local signs, the local signs and traffic conditions always take precedence over the information displayed in the apps. If a route in the apps does not correspond to the signposting on site, the user will follow the signposting on site. In any case, the local traffic situation prevails.

Article 7

The information in the apps is of a general nature. The information is not adapted to personal or specific circumstances and cannot, therefore, be considered as a personal or professional offer to the user. NodeMapp BV makes every effort to provide the information available completely, correctly, accurately, and up to date. However, it is not excluded that certain information may be outdated, incomplete, or otherwise incorrect.

If you notice any inaccuracies in the information provided in the apps, you can contact NodeMapp BV via the contact page on fietsknooppunt.be, wandelknooppunt.be, or nodemapp.com. The content of the apps may be modified, changed or supplemented without notice or notification.

NodeMapp BV tries to prevent interruptions in the operation of the apps as much as possible and cannot be held liable in any way for poor performance, temporary unavailability, or damage that may result from access to or use of the apps.

Article 8

The apps may contain hyperlinks to third-party websites or pages, or refer to them indirectly. The presence of these links does not imply in any way an implicit approval of their content. NodeMapp BV can therefore in no case be held liable for their content or characteristics or for any form of damage resulting from their use.

Article 9

Premium, hereinafter referred to as "subscriptions", is a paid feature within the apps that provides access to additional features. Subscriptions concluded within the apps have a duration of 1 full year. Subscriptions purchased via the website will not be automatically renewed upon expiry. Subscriptions purchased in the mobile app via the user's Google Play or iTunes account are automatically renewed upon expiry and can only be cancelled by the purchaser via their own Google Play or iTunes account. The cancellation must then be done according to the official instructions of Google Play or Apple (iTunes):

The user/purchaser of a subscription via Google Play or iTunes is fully responsible for cancelling his/her subscription via his/her own Google Play or iTunes account.

Article 10

Belgian law applies to the apps. In the event of a dispute, only the courts of the district of Leuven (Belgium) are competent.

Article 11

When using the apps, you agree with the Privacy Policy.

Article 12

This article lays down the conditions regarding the uploading of content (such as images, texts, etc.) by the user to NodeMapp's routing platform (including apps and other applications).

a. Intellectual property rights

By uploading content, the user declares to be the legal owner of all intellectual property rights related to such content. The user agrees not to upload content for which proper rights have not been obtained, including but not limited to copyrights, trademarks and portrait rights of third parties.

b. Permission for use

The user hereby grants NodeMapp a worldwide, non-exclusive, royalty-free licence to use, reproduce, adapt, distribute and make public the uploaded content on its platform and any related channels, such as social media, to promote the platform. This licence will remain in force for as long as the content remains on the platform. Moreover, the user agrees that even in the event that the uploaded content is later removed by the user or NodeMapp, NodeMapp retains the right to continue using the uploaded content according to the terms of this licence.

c. User responsibility

The user is solely responsible for the content uploaded to the platform. The user agrees not to upload content that infringes the rights of third parties, is illegal, obscene, offensive, defamatory, or otherwise inappropriate. NodeMapp reserves the right to remove content that violates these terms and conditions.

d. Warranties and indemnity

The user represents and warrants that all necessary rights, permissions and consents have been obtained to provide the uploaded content as described in these terms and conditions. The user agrees to indemnify NodeMapp against all claims, liabilities, costs and expenses arising from or related to the uploaded content.

e. Termination of access

NodeMapp reserves the right to terminate or suspend a user's access to the platform at any time and for any reason, including but not limited to violations of these terms and conditions. By agreeing to these terms when uploading content to the platform, the user agrees to be bound by all of the above provisions.

f. Attribution

When a user publishes content on NodeMapp's route platform, the user gives permission for his/her first and last name from the profile from his/her account to be listed as the author of the route. This information is displayed next to the published content, so that the user gets proper recognition for his/her contribution.

g. Reporting infringements

In case of an alleged copyright infringement related to content uploaded on NodeMapp's routing platform, notification of such infringement may be sent to the following email address: support@nodemapp.com. NodeMapp will make reasonable efforts to promptly and appropriately handle complaints related to copyright.
